Welcome to EvadiaGrace. EvadiaGrace is operated by SIDAK TRADING LLC ("EvadiaGrace," "we," "us," or "our"). These Terms of Service (the "Terms") govern your access to and use of evadiagrace.us, our online store, and the products and services made available through them (collectively, the "Services"). Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer the Services.

By visiting our website, creating an account, or placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

1. Eligibility and Accounts

You must be at least the age of majority where you live to make a purchase, or use the Services only with the involvement and permission of a parent or legal guardian. You agree to provide current, complete, and accurate information and to keep your account credentials secure. You are responsible for activity conducted through your account and must notify us promptly if you believe your account has been used without authorization.

2. Products and Product Information

We make reasonable efforts to display product descriptions, colors, sizes, and images accurately. Actual colors and appearance may vary because of lighting, screen settings, and the hand-finished nature of some designs. Product measurements may have minor variations where stated on the product or size-guide page.

Product availability and quantities may be limited. We may update product descriptions, prices, or availability, or discontinue a product, at any time. Unless expressly stated otherwise, our products are intended for personal cosmetic use. Follow the application and removal instructions, do not apply products to damaged or irritated nails or skin, and discontinue use if irritation occurs. Information on the website is general product guidance and is not medical advice.

3. Orders and Acceptance

Your order is an offer to purchase. An automated order confirmation acknowledges receipt but does not guarantee acceptance. We may decline or cancel an order for legitimate reasons, including suspected fraud, payment failure, product unavailability, pricing or listing errors, shipping restrictions, or unusually large quantities. If we cancel an order after payment has been captured, we will refund the canceled amount to the original payment method.

Please review your items, size, shipping address, and contact information before submitting an order. Contact us promptly if a correction is needed. We cannot guarantee changes or cancellation after an order enters processing or ships.

4. Prices, Payments, and Promotions

Prices are shown in the currency selected for the applicable market. Taxes, shipping charges, duties, and other fees are shown at checkout where applicable. You authorize us and our payment providers to charge the payment method submitted for your order. You represent that you are authorized to use that payment method.

Promotions, discount codes, gifts, and sale prices may have separate terms and may be changed or ended as permitted by law. Unless a promotion expressly states otherwise, discounts cannot be combined. A sale price alone does not make an item final sale; return eligibility is governed by our Refund Policy and any final-sale notice displayed before purchase.

5. Shipping, Delivery, Returns, and Refunds

Processing and delivery dates are estimates and are not guaranteed. Carrier, weather, customs, address, and other events outside our reasonable control may affect delivery. Please review our Shipping Policy for current processing times, delivery estimates, rates, tracking, and international-order information.

Returns, exchanges, damaged or incorrect items, and refunds are governed by our Refund Policy. These policies do not limit rights that cannot be waived under applicable consumer law.

6. Intellectual Property

The Services and their content—including our brand names, logos, text, graphics, photographs, videos, designs, software, page layout, and product presentation—are owned by or licensed to EvadiaGrace and are protected by applicable intellectual-property laws. We grant you a limited, revocable, nonexclusive, nontransferable right to access and use the Services for personal, noncommercial shopping purposes. You may not copy, reproduce, modify, distribute, sell, scrape, republish, or commercially exploit any part of the Services without our prior written permission or a right granted by law.

7. Reviews, Feedback, and Other Submissions

If you submit a review, photo, comment, suggestion, or other content, you confirm that it is truthful, based on your genuine experience where applicable, that you have the right to share it, and that it does not violate law or another person's rights. You grant us a worldwide, nonexclusive, royalty-free license to host, reproduce, format, display, and use that content in connection with operating and promoting the Services, subject to our Privacy Policy.

We may moderate or remove content that is unlawful, fraudulent, misleading, abusive, obscene, infringing, contains personal information, or is unrelated to the relevant product or Service. We do not promise to publish or retain every submission.

8. Prohibited Uses

You may not use the Services to violate any law; infringe intellectual-property, privacy, or other rights; submit false or misleading information; distribute malware or harmful code; interfere with security or operation; gain unauthorized access; scrape or harvest information except as permitted by law; impersonate another person; make fraudulent purchases; or harass, threaten, or harm others. The Services may include payment providers, shipping carriers, analytics, social media, customer-support tools, and links to third-party websites. We are not responsible for third-party content or services, but nothing in this section limits responsibility we have for your EvadiaGrace order under applicable law.

10. Shopify

Our store is powered by Shopify. Purchases from this store are transactions between you and EvadiaGrace, not between you and Shopify. Shopify may process information as described in our Privacy Policy and Shopify's own privacy materials.

11. Privacy

Our collection, use, and disclosure of personal information are described in our Privacy Policy. Please review that policy before using the Services.

12. Service Availability and Errors

We work to keep the Services available and accurate, but interruptions, typographical errors, inaccurate inventory, or pricing mistakes may occur. We may correct errors, update information, or cancel an affected order. If we cancel a paid order because of our error, we will refund the canceled amount to the original payment method.

13. Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided on an "as is" and "as available" basis. We do not warrant that access will always be uninterrupted, secure, or error-free. Any implied warranties are excluded only to the extent the law permits. This section does not exclude product warranties or consumer rights that cannot legally be excluded.

14. Limitation of Liability

To the fullest extent permitted by law, EvadiaGrace, SIDAK TRADING LLC, and our directors, officers, employees, affiliates, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages, including lost profits, revenue, data, or savings, arising from use of the Services. Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud, willful misconduct, or personal injury caused by negligence where such a limitation is prohibited.

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless EvadiaGrace, SIDAK TRADING LLC, and our affiliates, personnel, and service providers from third-party claims, losses, and reasonable costs arising from your unlawful misuse of the Services, your violation of these Terms, or your infringement of another person's rights. This obligation does not apply to the extent a claim was caused by our own conduct.

16. Suspension and Termination

You may stop using the Services at any time. We may suspend or terminate access if you materially violate these Terms, engage in fraud or abuse, or create a security or legal risk. Provisions that by their nature should survive termination—including intellectual property, disclaimers, limitations of liability, indemnification, and governing law—will survive.

17. Governing Law

These Terms are governed by the laws of the State of Colorado and applicable federal law, without regard to conflict-of-law rules. However, you retain any mandatory protections provided by the laws of the place where you live. Nothing in these Terms prevents either party from bringing a claim in a court or forum available under applicable law.

18. Severability, Waiver, and Assignment

If any provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them as part of a merger, acquisition, reorganization, asset transfer, or by operation of law, subject to applicable consumer law.

19. Entire Agreement

These Terms and the policies linked in them form the entire agreement between you and us concerning the Services and replace prior discussions or communications on the same subject. If a product, promotion, or program has additional terms, those additional terms apply to that offering; if they conflict with these Terms, the more specific terms control for that offering.

We may update these Terms from time to time. The revised version will be posted on this page with a new "Last updated" date. Where required by law, we will provide additional notice. Changes apply prospectively from their effective date.
